Terms of Service

1. Acceptance of Terms

By creating an account or using Whassabi (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms form a binding agreement between you (or the organization you represent) and Whassabi.

2. The Service

Whassabi is a software platform that helps businesses send WhatsApp messages, manage templates, run outreach campaigns, and track customer conversations using the Meta WhatsApp Business Cloud API. You are responsible for connecting your own WhatsApp Business Account (WABA) and for any messages you send through the Service.

3. Your Account

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity that occurs under your account, including activity by team members you invite. Notify us immediately at support@whassabi.com if you suspect unauthorized access.

4. Acceptable Use

You agree NOT to use the Service to:

  • Send unsolicited messages to recipients who have not opted in.
  • Send content that is unlawful, harassing, deceptive, fraudulent, or infringing.
  • Violate Meta's WhatsApp Business Messaging Policy or Commerce Policy.
  • Circumvent rate limits, quality controls, or anti-spam mechanisms.
  • Resell, sublicense, or proxy the Service to unauthorized third parties.
  • Send messages outside the 24-hour customer service window without an approved template.

Violations may result in immediate suspension or termination, and may be reported to Meta for enforcement against your WABA.

4a. Third-Party AI Providers (Optional Translation)

Whassabi offers an optional translation feature where you supply your own API key for a third-party AI provider (Google Gemini, Anthropic Claude, or OpenAI GPT). By enabling this feature in Settings, you agree that:

  • The AI provider you choose is a separate vendor governed by its own terms and privacy policy. You are responsible for complying with that vendor's terms.
  • All usage charges, rate limits, content policies, retention practices, and availability of the AI service are determined by your chosen provider, not by Whassabi.
  • Whassabi passes message content to your provider only when you have explicitly configured an engine and key, and only for the purpose of translation as you initiate it. Whassabi does not retain a copy of provider responses beyond what is necessary to display the translation in your dashboard.
  • You will not enable translation for content that your chosen provider's terms prohibit (e.g., regulated medical, legal, or financial advice if disallowed by that provider).
  • Translated text is still subject to Meta's WhatsApp Business Messaging Policy when delivered through WhatsApp. The fact that text was machine-translated does not relax any obligation to obtain proper opt-in consent or to honor opt-out requests.

You can disable translation at any time in Settings → Translation. Whassabi does not warrant the accuracy, completeness, tone, or cultural appropriateness of any machine translation; you remain responsible for the final messages your business sends.

5. Opt-In & Consent

You represent and warrant that every contact you upload to Whassabi has provided verifiable opt-in consent to receive WhatsApp messages from your business. You are solely responsible for maintaining records of consent and for honoring opt-out (“STOP”) requests promptly. Whassabi enforces opt-out at the platform level, but the legal obligation to obtain consent rests with you.

6. Fees & Billing

Subscription fees, per-message costs, and WhatsApp conversation charges levied by Meta are billed according to the plan you select. Meta's WhatsApp messaging charges are passed through at cost. Fees are non-refundable except where required by law. We may change pricing with at least 30 days' notice.

7. Meta Platform Terms

Your use of the Service is also subject to Meta's WhatsApp Business Messaging Policy, Meta Platform Terms, and any other terms Meta imposes on WhatsApp Business API users. If those terms conflict with these Terms, Meta's terms control with respect to the WhatsApp integration.

8. Intellectual Property

Whassabi and all related software, branding, and documentation are owned by us and our licensors. You retain ownership of your message content, contacts, and campaign data. You grant us a limited license to process that content as necessary to operate the Service.

9. Termination

You may cancel your account at any time from the dashboard or by emailing support@whassabi.com. We may suspend or terminate your account for breach of these Terms, abuse, fraud, or at Meta's direction. Upon termination, we will delete your data in accordance with our Privacy Policy.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that messages will be delivered, that Meta will approve your templates, or that the Service will be uninterrupted or error-free. Message delivery depends on Meta and on recipient carrier networks.

11. Limitation of Liability

To the maximum extent permitted by law, Whassabi's total liability arising out of or related to the Service in any 12-month period will not exceed the fees you paid us during that period. We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
